Public Hearings
7:00 PM Continued Abbreviated Notice of Resource Area Delineation to determine the boundary of the resource area for vacant land off of Holmes Street, Map 74, Lot 8 for Joseph Mahoney, Zipline 747, LLC represented by Morse Engineering Co., Inc., 19 Union Street, P.O. Box 92, Scituate, MA 02066 (DEP #SE175-0648)
Mr. Greg J. Morse, P.E. made the presentation concerning the validity of a wetland delineation of a 38.9 acre property located off of Holmes Street. The Bordering Vegetated Wetland (BVW), shown in green on a Plan dated 6/2/14, was flagged by Brad Holmes, P.W.S. of Environmental Consulting & Restoration, LLC on November 11th, 14th & 25th, 2013. Mr. Holmes used the usual methodology of analyzing vegetation, soils and hydrology. The site is not located within a Priority Habitat & Estimated Habitat of Rare Species or Vernal Pools according to mapping of the Massachusetts Natural Heritage & Endangered Species Program.
Mr. John Delano of John W. Delano & Assoc., Inc., consultant for the Commission, submitted a review report dated 7/22/14 and was present at the meeting to discuss. For his report, he reviewed the Plan and the soil mapping for the area. The soil regions, both wetland and upland, are poorly drained. The water is close to the surface, even in the upland areas. Consequently, Mr. Delano added, there are transitional wetland plants on either side of the BVW making it a difficult site.
Mr. Delano commented that there was a discrepancy between his calculations of the length of the line and as reported by the applicant’s representative. As this information may be scrutinized in the future, he suggested that it is important to discuss this with the consultant so as to agree upon the distance. Also, Mr. Delano suggested a few minor changes in the location of the flagging and requested that the Commission require a revised Plan.
Mr. Kemmett asked for comments from abutters. Those present were:
Mr. Sean Kealy, Holmes Street – Mr. Kealy wanted to know what the project was and where it was going. Also, he asked on behalf of Robert and Marian Scott, who were not able to attend, if the coyotes and fisher cats in the area would be protected.
Mr. Morse answered that nothing is being proposed at this time, but abutters would be notified if a proposal was made in the future. Mr. Delano answered that he observed indicators of many wildlife species during his inspection, such as animal scat, deer carcass remains and tree cavities where wood ducks generally reside. He added that it was quite a populated area and a major habitat. He said that if it was there were endangered species, they would be required to file an application with the Massachusetts Endangered Species Act (MESA).
